Terms & Conditions
By painting or engaging with Paint The Earth you acknowledge and accept the following Terms and Conditions:
General
- Your booking request is not confirmed until we have replied to you in writing that it is accepted.
- If you are unable to fulfil your booking, you are obligated to cancel it as soon as possible using the booking link we will send you after accepting the booking, or contacting us on phone or email.
- Booking durations must be strictly adhered to during weekend and school holiday times. If you feel the default booking duration will not allow enough time, please contact us at the time of your booking request to see if we can accommodate an increased booking duration.
- Children under 14 years old must be accompanied and supervised by a parent, guardian, or caregiver at all times whilst at Paint The Earth. In accordance with NZ legislation, we do not allow children under 14 years old to be left alone in the Studio as we do not have the provisions for their supervision or care.
- Should you not be able to complete your piece within the allocated booking duration and we cannot accommodate an extension to your booking duration, we do offer a Work In Progress opportunity.
- For all Work In Progress pieces the items must be paid for in full at the time of the initial booking, then you will have up to two weeks in a single booking to return and complete your piece. Our standard glaze and kiln duration will apply once the piece is finished.
Ceramic Painting
- Ceramics are from the earth and hence are not uniform in composition or finish. While we take every care to handle, glaze and fire your finished pieces to a high standard, variations to the final finish may be apparent for many reasons, i.e. due to poor handling, contamination, paint application, paint thickness, etc. Paint The Earth will not be responsible for these imperfections.
- Ceramics are fragile in their non-fired state and must always be handled with care to prevent cracking or breaking. Broken ceramics will have very sharp edges so should only be handled by trained staff, therefore please advise us immediately of any breakages.
- Any breakages of customer pieces prior to glazing and firing will incur a 50% charge of the retail price. If the customer chooses to have the broken piece(s) glazed and fired then the full retail price will be payable.
- Our standard glazing and kiln duration will be advised on the day of your booking. If this is longer than the time advised we will contact you directly, otherwise please return to the shop after the advised collection date to pick up your finished pieces.
- Finished pieces that have not been collected within three months may be donated to charity without notice.
Etiquette
- The team at Paint The Earth want to offer an enjoyable and relaxing experience for all customers, hence excessive noise and/or disruption will not be tolerated. Please respect our customers and staff for the enjoyment of all.
- We also want you to express your creativity but any images or words deemed by management to be racist or offensive will not be permitted.
- For the safety of customers there is not to be any items placed on or dropped/thrown off the upstairs balustrade wall. Any issues will be treated seriously by management and the customers party may be advised to leave immediately.
- Please advise any special needs in advance of your booking so we can be prepared and as accommodating as possible.
- At the sole discretion of management, we reserve to right to cancel any booking without notice.
Payments
- Prices are shown in New Zealand Dollars including Goods and Services Tax, unless stated otherwise.
- Payment is required in full at the time of initial painting, unless agreed to in writing prior by management in which case finished items will not be available for collection until payment has been made in full.
- Prices exclude shipping but can be arranged, however full responsibility lies with the purchase for risk of delivery damage.
Privacy
- You accept that Paint The Earth and its suppliers collect, store and process your personal data and data collected automatically when making this booking. Data is also collected while communicating with and visiting the shop.
- This data includes, but is not limited to: name, e-mail address, phone number, preferences and location and device specifications.
- We will not share your information with any third party.
- You may request a copy of the data we have collected, by sending an e-mail to info@painttheearth.co.nz
Limitation of Liability
- All pieces are sold in good faith as described. Paint The Earth make no warranties expressed or implied as to any item for any particular purpose.
- Paint The Earth will not be responsible for any accidental, consequential or any other special damages which may occur even if Paint The Earth or any agents are made aware of such damages or the possibility of damages.
- While normal efforts have been taken to ensure complete security and safety of all information and products, Paint The Earth will not be responsible for any damages resulting from server attack, hack, or virus, be it against our servers or any of our partners.
- In no event will Paint The Earth be responsible for any amount which exceeds the amount paid by the customer for an item at issue.
Miscellaneous
- All information offered by Paint The Earth is subject to change without notice.
- We accept it is your right to publish your opinions, however we respectfully ask that any issues are raised with the management of Paint The Earth directly and allow us a reasonable time to resolve any issues before publishing any negative feedback.
After Hours Bookings
- After-hours bookings are intended for larger private or corporate groups outside of our normal opening hours allowing your booking to have the Studio for your exclusive use.
- Bookings are generally available on Wednesday to Saturday evenings, with a start time between 5:00pm to 6:00pm and latest finish time of 9:00pm. Other days and times will be considered by request.
- After hours bookings require a Studio Fee of $150.00 payable at the time of confirmation to secure your booking date and time. Your booking is not confirmed until Paint The Earth has provided written confirmation and received payment of the Studio Fee.
- After hours bookings also have a Minimum Spend of $400.00. As a guide this is the equivalent of 8-10 painted mugs from our standard dinnerware range.
- For clarity the Studio Fee is in addition to the Minimum Spend value.
- All values noted are in New Zealand Dollars and include GST, unless noted otherwise.
- Payment of all the groups’ painted pieces are to be paid in full at the immediate conclusion of your booking. We can offer bulk, individual, or split payments; for example, if a company pays up to an agreed value but an individual chooses a more expensive piece and pays the difference.
- Invoices can be provided upon request with prior approval by Paint The Earth. Payment must be received in full prior to the collection of any finished pieces.
- If your group is unable to attend at the booked day & time, please engage with us as early as possible to consider alternative dates. If agreeable by both parties the Studio Fee can be transferred once only to an alternative date. Any further date changes will forfeit the Studio Fee.
- Cancellations received in writing with at least 14 days’ notice can receive a full refund of the Studio Fee, however cancellations with less than 14 days’ notice are not eligible for a refund of the Studio Fee.
- After hours booking group can bring their own food and beverages into the Studio. Food is intended to be light nibbles or finger foods. Responsible drinking is required and any individuals or groups not drinking responsibly will be required to leave.
